THIRD-PARTY ACTIONS

In some cases, a negligence or other claim may be pursued against a third-party who is responsible for your injuries. These actions allow injured workers to pursue certain damages not allowed under Vermont workers’ compensation laws, such as pain and suffering. We review each workers’ compensation claim to determine whether you have a third-party claim, and if you do, we will pursue it on your behalf.

SOCIAL SECURITY DISABILITY

Receipt of workers’ compensation benefits may detrimentally effect the amount of Social Security Disability (SSDI) benefits received. For our clients who also receive SSDI benefits, we structure the settlement to reduce the Social Security offset and ensure that our clients receive the maximum benefits available. We also make sure that Federal requirements are satisfied and that Medicare’s interest is considered when settling workers’ compensation claims for those receiving SSDI or about to receive SSDI.
